01 Subject of the Agreement

The following terms and conditions apply to the sale and shipment of all goods ordered by the buyer using www.mooisa.com

02 Exclusivity of our General Terms and Conditions

Our general terms and conditions are exclusive. We do not recognize any conflicting or deviating terms and conditions of the users, unless we have expressly agreed to this in writing.

03 Consequences of the Agreement

3.1 You can choose products from our online store and add them to your shopping cart and order them from us with a payment obligation. You accept a payment obligation if you accept our general terms and conditions and click on the 'Buy now' button. You can view and change your delivery address and other information at any time during your order.

3.2 You place your order via our website or via e-mail so that you receive a confirmation of your order by e-mail. The agreement between you and us does not come into force immediately after your order, nor immediately after confirmation of receipt, but only upon acceptance of your order by us. You will receive acceptance of your order by email no later than within 7 days by our acceptance of delivery of your ordered goods.

We do not accept telephone orders as we only accept orders on paper so that both the customer and ourselves can check this at any time.

3.4 If you place an order via our homepage www.mooisa.com , you will receive a confirmation by e-mail (acknowledgment of receipt). The agreement between the seller and the buyer is not concluded by the buyer's order or the seller's confirmation, but by the seller's acceptance of the order.

3.5 After the order has been received and accepted by us, it is no longer possible to make changes to the order (size, color, address, or any other change). We have a fully automated order and production process, which means it is not possible to make changes to your order. Financial consequences for providing incorrect information (for example: Delivery address) will be fully borne by the customer.

04 Shipping

Delivery takes place after confirmation of receipt and processing of the order. We strive to process the order as quickly as possible and deliver the ordered goods in the fastest possible manner. If we cannot deliver according to schedule, we will inform you as soon as possible. We reserve the right to make partial deliveries unless this is unreasonable for the buyer to accept. If your order cannot be delivered to an address you entered incorrectly, after which your order is returned to us, we will be forced to pass on the costs to you in order to resend your order to you. The costs for this are twice the shipping costs of your order. An error in addressing made by Mooisa is of course at our own expense.

Package is lost after delivery to a collection point: Unfortunately, it is currently not possible to have your order delivered to a collection point. You cannot enter an address of a collection location on your own initiative, we do not offer this option. If you enter a collection location for the delivery address, this is at your own risk and there is a chance that the package will be lost. In that case, the costs for any resending will be at your own expense.

05 Terms of Ownership and Copyright

We retain the right of ownership of the ordered product, as well as of all other items of the same order, until the customer has fulfilled all demands and claims arising from his business relationship with us. The copyright holder of the designs of our products is Mooisa or other third parties. Any reproduction, editing or other use of the designs for commercial purposes is a violation of copyright law and is prohibited.

06 Payment and Shipping Costs

All prices are including VAT and excluding shipping costs. The purchase price is due before delivery, unless a down payment has been agreed. Shipping costs will be indicated separately before you finally place your order. Shipping costs as indicated in the webshop. Please also see the shipping costs as stated for the items, as well as our shipping costs under the heading "shipping". Return costs are at your own expense. For packages larger than 100 cm, the return costs are very high because they were delivered to you by transport company and must also be returned by transport company. Please take into account costs of approximately €100. Therefore, make a well-considered choice about what you order so that you do not incur unnecessary costs on returns. Before returning anything, check our return instructions page, which can be found at the bottom of each page.

07 Settlements

The right of retention or settlement of recoveries is only possible if these counterclaims have been declared or acknowledged by us. The buyer can only claim a right of retention on claims arising from the same order.

08 Delay

If the buyer does not pay, a default interest of 5% will be charged on the outstanding payment (if the customer is an entrepreneur, legal entity under public law or the public sector, 8% default interest will be charged) above the relevant base interest. The contractual partner has the right to prove that we would have suffered less damage or no damage.

09 Warranty and Liability

The warranty is subject to legal regulations, except as described below. The images of our products on the internet may not accurately reflect the quality, size or color of the original. With natural materials, minor variations in structure and color may occur. We therefore expressly supply goods of the same type and quality. The warranty period of 1 year applies from the delivery date. If a defect occurs within the statutory warranty period, we reserve the right to either replace the item with one of equal value or repair the defect. If replacement is not possible or the replacement delivery is defective twice, the customer has the right, in accordance with legal requirements, either to terminate the agreement or to request a reasonable reduction in the purchase price. Further requirements remain unaffected. We are only liable for material damage of such a nature that it was not caused by intentional and gross negligence in accordance with the legal requirements. In the case of minor negligence, we are liable for financial damages or property damage only when essential duties (cardinal duties) of the contract have been violated. Liability is limited to regular, typically foreseeable cases of damage. Liability for (consequential) damage not covered by this agreement is excluded. To the extent that our liability is excluded or limited, this also applies to the personal liability of our agents or other persons associated with Mooisa.

10 Discount coupons and discount codes

Discount vouchers cannot be exchanged for cash. In the event of cancellation of an order paid for with a discount voucher, the buyer is not entitled to a cash refund.

Discount codes can only be used at the time of ordering. It is not possible to apply the discounts to your order afterwards. Our payment and production process is fully automatic, so it is not possible to make changes to your order or payment afterwards. Since your order is immediately put into production, we immediately incur costs to produce your order. Forgetting to redeem a discount code is therefore no reason to terminate the agreement.
